Fundraising terms and conditions

Thank you for your interest in raising funds for The Royal Marsden Cancer Charity (Registered Charity No. 1095197) (“RMCC”). These rules apply to all voluntary fundraising activity carried out in aid of the RMCC and by signing up to fundraise for RMCC you agree to comply with them.

Fundraising

You agree to organise fundraising activities as an independent supporter of RMCC. You will refer to such fundraising activities as raising money “in aid of” RMCC, rather than on RMCC’s behalf, and RMCC does not accept any responsibility for these activities (see Liability, below).

You agree that you will comply with any instructions or guidance provided by RMCC relating to your fundraising activity.

You will be responsible for any costs or expenses incurred or arising out of or in connection with your fundraising activity.

If you are taking part in a challenge and your travel and/or accommodation costs will be paid by The Royal Marsden Cancer Charity, you agree that it is your responsibility to inform your donors that a percentage of the money you raise will be used to pay the costs of your challenge.

Proceeds of your fundraising

You agree to pay all of the proceeds raised by your fundraising activity to RMCC as soon as possible after completion (and subject to any agreed timescale), and in accordance with RMCC’s instructions. You may not deduct any costs or expenses unless otherwise agreed with RMCC.

You will comply with any investigations RMCC undertakes if it has grounds for suspecting any misuse or misappropriation of funds. RMCC may take any action it thinks fit to establish that all funds are accounted for correctly.

You will encourage donors and/or sponsors to make gift aid declarations where eligible, which may enable us to recover basic rate tax on such donations. Further information about Gift Aid can be found on our website or via GOV.UK

If you are unable to complete your fundraising event, due to cancellation, injury or any other reason, you must ask your sponsors if they would like their donations to be refunded.

Personal Data

RMCC will handle any personal data you provide in accordance with data protection law. For information on how we handle your personal data, please refer to our privacy policy which can be found at www.royalmarsden.org/privacy

You should consider whether you have any data protection obligations in relation to your fundraising activities. To the extent that you do, you agree to comply with those obligations. For example, you should only send to RMCC personal data that we need, and you will notify the individual(s) concerned that you are doing so.

Content

If you provide photographs or videos taken during your fundraising activity to RMCC, you agree that these may be used by RMCC for commercial and/or fundraising purposes.   

By sending such photographs or videos to us, you are also confirming that anyone featuring prominently in any such photograph or video is aged 16 or over, and that they have consented to their image being used in this way.

Use of logo and branding

RMCC must consent to any use of its logo, name, branding and other intellectual property rights. All rights and goodwill attaching to our intellectual property rights are, and shall remain, the sole property of RMCC.

You must ensure that whenever RMCC’s logo is used, it is acknowledged that RMCC’s identity is protected by trademark and copyright law, and that all communications featuring the RMCC brand identity or logo are accompanied by: “The Royal Marsden Cancer Charity. Registered Charity no. 1095197”.

Any fundraising opportunity or condition that requires the use of RMCC’s registered charity number must have prior written approval from RMCC.

Liability

You accept that any risks arising out of your fundraising activity are your responsibility, and you must take all reasonable precautions to protect the health and safety of all those participating in, involved with or attending your fundraising activity. RMCC does not have any responsibility for these matters and will not be liable to you, your helpers or your guests for anything that may occur.

You will comply with any applicable laws and regulations relating to your fundraising activity, including, but not limited to, any such laws or regulations notified to you by RMCC.  This will include obtaining any necessary licenses, consents or permissions e.g. if you are holding a raffle or lottery, or are proposing to sell alcohol.

You acknowledge and accept that RMCC’s insurance policy will not cover your fundraising activities.

You will not do anything that threatens RMCC’s reputation or name. If you do, RMCC has the right to ask you to stop your fundraising activity immediately.

If you are under 18, you confirm that you have shown these terms and conditions to your parent/guardian, and they have agreed to accept responsibility for complying with these terms and conditions.

Term

Either you or RMCC may bring this Agreement to an end at any time by giving notice in writing to the other.  If neither of us has done so within one year after the Agreement begins it will automatically come to an end unless you let us know that it should continue. When this Agreement ends you must cease all fundraising activities and return any unused materials we have provided to you.
